In its confirmation of the Tribunal, the Appeal Division stressed the favourable nature of the application of such agreements “in the case of full, unscrupulous disclosure and understanding”. The Appeal Division ruled that a party who wants to invalidate a marriage contract “must prove, through clear and convincing evidence, that `the party has performed the agreement unintentionally` or that the agreement is ruthless.” Quoted N.J.S.A. 37:2-38.
